In order to simultaneously provide a conditional guarantee and encourage Participant's full commitment & participation in seminar, if Participant is dissatisfied, he/she may obtain a full refund only after attending & participating fully in all 9 sessions of the seminar in one quarter. Otherwise, there is no refund for this seminar.
Please be sure to read your entire Agreement for Participation in Dreamality Life I below, especially sections 2 and 3 in bold. Then indicate your agreement by checking the box on the right in order to register for your seminar:
1. Nature of Services: This is an agreement between Dreamality Education & Coaching (“Dreamality”) and seminar participant (“Participant”) named on the front of this form for involvement in a seminar called Dreamality Life I (“seminar”). Seminar consists of 9 group sessions. Content and dates of seminar are subject to upgrade without notice.
Dreamality provides techniques and methods for Participant to be successful, effective and fulfilled in life. Dreamality does not provide counseling or psychotherapy. Seminar is not intended to replace the advice of psychologists, psychiatrists or other appropriate health care practitioners. It is also not intended to diagnose or prescribe treatment for any illness or disorder. If Participant is already undergoing physician-prescribed treatment, he/she should seek the advice of his/her doctor before altering or stopping such treatment. Participant understands that Dreamality reserves the right to ask anyone to leave the seminar at any time for any reason.
2. Confidentiality: Both Dreamality and Participant may each obtain confidential, proprietary or/and copyrighted information and agree to keep and maintain such information confidential at all times, and not to disclose or use such information, directly or indirectly, without the prior written consent of the party affected. In order to provide a secure place to share thoughts and feelings, Participant agrees to keep all information revealed by other Participants confidential.
In order to maintain this confidentiality agreement in a virtual setting, it is agreed that Participant will at no time record the sessions and only the named registered Participant will view the live course videos or any recordings provided by Dreamality.
In order to participate in the virtual seminar, the Participant is required to have a device with internet video conferencing abilities, including both audio AND video. Participant’s video must be turned on throughout each session, except for short periods when necessary.
3. Tuition Policy: Participant is responsible for and agrees to pay the entire tuition of the seminar on the due date(s), even if Participant were to drop out of the seminar for any reason at any time. If Participant registers for a seminar in the upcoming quarter or future quarters, Participant will still be charged for and agrees to pay the entire tuition during the upcoming quarter. If choosing to pay in installments, Participant agrees to provide a valid credit card for all future payment dates immediately upon registration.
In order to simultaneously provide a conditional guarantee and encourage Participant’s full commitment & participation in seminar, both parties agree to the following: If Participant is dissatisfied, he/she may obtain a full refund after attending & participating fully in all 9 sessions of the seminar in one quarter. In other words, if Participant misses one or more sessions, he/she is no longer eligible to obtain a refund. Participant has up to 7 days after the 9th session to request a refund, after which a refund is no longer available.
If Participant wishes to drop out of Dreamality Life I for any reason after registering, anytime before the seminar starts, or during the seminar (up to and including the 9th session), he/she can only receive credit towards future seminars (as available). The amount of credit will be calculated based on when Participant drops out of the seminar. Participant has one year from the date of this agreement to use his/her credit. There is a $50 transfer fee if Participant receives credit for / postpones the date of seminar he/she has registered to attend. The tuition of this seminar is not transferable to other individuals.
Participant understands that if health circumstances or governmental regulations necessitate closing the in-person sessions at any time, then the seminar will be provided on Zoom. Under such a scenario, if Participant chooses not to attend any sessions, there is no refund, though Participant can receive credit toward future seminars (as available).
Upon registering, Participant does NOT have the right to cancel this agreement at any time, according to California and federal law.
4. Waiver: Participant declares that he/she is attending the seminar upon his/her choice consciously and responsibly. Participant takes responsibility for his/her own mental and physical well-being, including for any risk related to Covid-19 or any other illness. If Participant experiences any symptoms related to Covid-19, Participant agrees to voluntarily stay home and participate by Zoom for the affected session(s). Participant hereby willingly, voluntarily, and knowingly releases Dreamality of any liability whatsoever pertaining to Dreamality Life I and will indemnify and hold harmless Dreamality and any of its representatives from any injury, damages, claims, costs and expenses resulting from questions, actions or services provided during Dreamality Life I.
5. Participant Responsibilities: While Dreamality can support Participant, ultimately Participant is responsible for his/her own achievements and success. Dreamality does not promise that Participant will take any specific action or attain any specific goals. In order to achieve optimal success, Participant agrees to do his/her best to fully participate and apply what he/she has learned in the seminar in ethical ways. Participant also agrees to either internally resolve any issue that Participant may have with Dreamality or in regards to any topic brought up by Dreamality, or bring up the issue so Dreamality and Participant can come to a mutually satisfactory agreement.
To get full benefit from the seminar, Participant understands it is his/her responsibility to attend and participate fully in all 9 sessions. If it’s truly necessary to miss 1 session at most, Participant agrees to do his/her best to get caught up fully before the following session if possible. While catching up is valuable, it does not replace the full experience of attending a session. If Participant misses more than 1 session, he/she understands that Participant would be missing too much for his/her own good and Dreamality would likely recommend Participant get credit and transfer to another quarter to complete the seminar.
6. Dispute Resolution: Any dispute under this Agreement shall first be submitted to mediation for an attempt at resolution, with such mediation being conducted by a mutually agreeable party, or if no such party can be agreed upon, by a mediator appointed by the Los Angeles office of the American Arbitration Association (“AAA”). If the dispute is not resolved by mediation, the dispute shall be settled by binding arbitration in Los Angeles, California in accordance with the rules of AAA then existing. Each party waives any right to adjudicate any dispute in any other court or forum. The parties will abide by any decision in the arbitration and any court having jurisdiction may enforce it.
7. Nature of Agreement: This agreement shall, in all respects, be governed by the laws of the State of California applicable to agreements executed and to be performed within California. This agreement constitutes the entire understanding and agreement of the parties and no amendment, change or modification of this Agreement shall be valid, unless in writing and signed by all the parties.
